Attorneys Help Negotiate With Mortgage Lenders
I frequently receive request from homeowners for assistance in negotiating a modification of their home mortgage to avoid foreclosure. I have usually advised people that they should themselves contact their mortgage lender to see if the lender can offer a modification of payment or interest amounts to avoid foreclosure. It is usually very expensive to pay their attorney hourly to conduct explore and negotiate with a mortgage lender to modify a mortgage loan. Loan modification and mortgage assistance is generally not a legal issue; the lender legally can refuse or grant changes in a private mortgage in the lender’s discretion.
However, I have just recently become of aware of as free source of attorney help in dealing with mortgages. The Florida Bar has found a group of attorneys around the State who are offering to consult with financially distressed homeowners and to help the homeowners deal with their mortgage lenders prior to foreclosure.
The Florida Bar, its Business Law Section, and its Young Lawyers Section have made the following announcement.
"We have established a Statewide toll-free telephone hotline to help homeowners who are not in foreclosure, but fear the possibility of foreclosure. Homeowners are urged to call the Hotline on complete and on-line intake form on The Florida Bar's website www.floridabar.org or by calling 866-607-2187. The caller will answer a few initial questions to ensure accurate placement with a pro bono attorney by Florida Legal Services. That attorney will in turn negotiate with the Lender on behalf of the client with the hope of creating a relationship where the Lender and the client can together create a loan that allows the client to remain in the home thus avoiding foreclosure - a win-win situation for all involved."
People who think that an attorney could help them save their home from foreclosure should take advantage of the generous assistance from the attorneys working with the Florida Bar program.

We need your help. In Feb 2006 my husband and refianced our home with homestart mortgage, we signed paperwork with a fixed rate, they sent us copies of a negative ARM mortgage. our mortgage was frauded, i did call and make a police report of this fraud mortgage but i need an attorney to keep my house because we are looking at losing it if i can't get it straighten out. i need someone to fight for my house. if i lose our home i lose our best income, my home daycare. without a home, i have no daycare. can't operate one out of an apartment. i did have an attorney but he feel off the face of the earth and i can't get him. he said he went to the bartow court house and found the same company (people) did this to three other people but they were smart enough to catch it in three days, stupid me, i trusted the company who came out to my house and did the closing at my dinning room table, i never thought this could happen in a million years. i have had one attorney tell me "maybe you just signed too many papers and you don't remember signing this" NOT TRUE. we know what we signed, i know the box for fixed being check marked or not. i have a good faith estimate starting a 1% fixed rate for 24-48 months after the signing and other documents that we signed before the mortgage signing. the company went out of business within months after our signing. the mortgage paperwwork is not even noterized at all and the paper that is noterzied, we did not sign, the notary did and you can tell. we need an attorney to file a "cause of action" right away even if you don't take the case but i pray to god that you will. with all my heart i am telling you the truth about this mortgage, please say that you will help us keep our house. we started our mortgage at 106,000.00 and it is now 120,000.00. please help us. i feel that we are able to proof fraud. We would like to make an appointment for Fri November 21 to discuss our situation. A couple questions before hand Is there anyway to protect inheritance from Judgement holders? Also is their protection against judgement holders against possible life insurance as us being benef.? We have several judgements What are your fee's???
